The use of this web site is free to both merchants and consumers and is subject to the following terms and conditions.

 Purchase or participations may not be assigned or transferred to any other person or entity. You must promptly inform the Company of any and all of the following: changes in the expiration date of any credit card or debit card used in connection with The City Discount Card; change to Your name, the postal/zip code for Your billing address, or e-mail address; apparent breaches of security, such as loss, theft, unauthorized disclosure or use of an ID or Password. Until Company is notified by U.S. mail or e-mail with return receipt enabled of a breach in security, the member or participant will remain liable for any unauthorized use of The City Discount Card.

 

 LOGIN NAME & PASSWORD. Access to, and use of, The City Discount Card is through the use of a unique Login Name and Password as selected by You. You hereby agree to keep Your Login name and Password strictly confidential. For security reasons, the Company will not release Login Names or Passwords. Unauthorized access to The City Discount Card is a breach of this Agreement and may be a violation of law. You acknowledge and give Your permission to the Company to collect statistical information on Your source Internet Provider address, and agree that if You share Your unique Login Name and/or Your Password with any another individual or entity, that Your access to The City Discount Card is subject to immediate termination without notice or reimbursement of any kind.

 

REPORT YOUR LOST OR STOLEN CARD IMMEDIATELY.  LIQUIDATED DAMAGES FOR FRAUD. You hereby agree not to report, as lost or stolen, any credit card or debit card which You have used in connection with any payment to The City Discount Card, or as unauthorized, any charge for any goods or services, including for any Paid Trial Purchase or participation or Full Purchase or participation Plan, for which You do not have good reason to believe is, in fact, lost, stolen or unauthorized. You hereby agree that in the event of any such fraudulent reporting of a lost or stolen credit card used to obtain goods or services from The City Discount Card, or any fraudulent reporting of an unauthorized charge to The City Discount Card on Your credit card or debit card which has been made by You, or anyone under Your authority, at a time when a charge or other obligation for payment for goods and/or services to The City Discount Card remains outstanding, You shall be personally liable to the Company for liquidated damages in the amount of US$25,000.00. The liability for liquidated damages specified in this Paragraph shall not limit any other liability You may have for any breach(es) of any other terms, conditions, representations and warranties set forth in this Agreement.

 

ANNUAL FEES, OTHER FEES AND BILLING. You hereby agree that, upon your Purchase or Participation in The City Discount Card, you shall be subject to certain immediate and automatically recurring charges which shall be billed to your credit card, unless you cancel your Purchase or participation under the terms and conditions of this Agreement. Purchase(s) Participation or Participation(s), or participant(s) is defined as a merchant, person, persons or entity whether an individual(s), Corporation(s)  or other entity advertising a good, service or any paid or free advertisement on citydiscountcards.com. Participation may also be defined as an individual, company or person that has received or purchased or used or attempted to use a City Discount Card. The charges which you will incur, and hereby authorize, are as follows:

 

a) Automatic Renewal of Purchase or Participation. All Purchase or Participations shall renew, automatically and without notice, for successive periods of approximately one year commencing upon the expiration of the initial Purchase or participation, and continuing thereafter for successive periods of approximately one year unless and until this Agreement is canceled by you or the Company in accordance with the terms hereof. Each period of approximately one year shall be referred to as the "Purchase or Participation Period."

 

b) Cancellation by Company. The Company may, at any time and at its sole discretion, cancel any Purchase or participation; provided, however, if the Company cancels any Purchase or participation prior to its expiration, the Company shall provide a full term until the PURCHASE OR PARTICIPATION reaches its expiration date.

 

c) Cancellation of Automatic Renewal of Purchase or participation to PURCHASE OR PARTICIPATION PLAN(S). TO CANCEL AUTOMATIC RENEWAL OF THE PURCHASE OR PARTICIPATION, YOU MUST NOTIFY THE COMPANY AT LEAST THIRTY (30) DAYS PRIOR TO THE END OF THE PAID PERIOD, BY Certified LETTER delivered to and addressed to Cancellations/ The City Discount Card. 608 Danley Rd., Fort Myers Florida 33907. Or email with return receipt enable to The City Discount Card Network your intent to cancel your participation with 30 days notice.

d) Cancellations Effective Upon Receipt By Company. All cancellations received by the Company will be effective upon receipt.

 

e) No Pro-Rated Refunds for Cancellation of Annual Purchase or participation. You hereby acknowledge and agree that if You cancel Your Purchase or participation, or if Your Purchase or participation is cancelled by the Company, Your username and password will be removed from the system at the end of the then current Purchase or participation period and that You will be entitled to receive the full benefits of Your Purchase or participation until the end of such period. You shall not be entitled to any pro-rated or partial refund if You cancel Your Purchase or participation before the end of the then current Purchase or participation Period. You agree that if you cancel at any time after purchasing a Purchase or participation to The City Discount Card (e.g., 20 minutes after you sign up), You will still be charged for the full Purchase or participation period. You acknowledge and agree that "instant access" to The City Discount Card shall not mean "free preview" of The City Discount Card.

 

f) Credit Card, Debit Card and Checking Account Charges Authorized. You hereby authorize the Company to charge Your credit card, debit card, or checking account (which You hereby acknowledge was entered by You into the sign-up page, or given to the Company by you by other means) to pay for the ongoing Purchase or participation Fees, if any, to The City Discount Card at the then current Purchase or participation Rate. You further authorize the Company to charge your credit card, debit card, or checking account for any and all purchases of products, services and entertainment available through, at, in or on, or provided by The City Discount Card. You agree to be personally liable for all charges incurred by you during or through the use of The City Discount Card. Your liability for such charges shall continue after termination of your Purchase or participation.

 

g) Automatic Credit Card, Debit Card Debit, or Checking Account Debit. All charges to Your credit card, debit card, or checking account for the Purchase or participation and/or any other Purchase or participation Plan, under the terms and conditions of this Agreement, if any, will be made in advance by automatic credit card, debit card, or checking account debit and you hereby authorize the Company and its agents to process such transactions on Your behalf.

 

h) Non-Refundable Charges. All charges to your credit card, debit card, or checking account are nonrefundable. In order to avoid such charges, You must cancel your Purchase or participation under the terms and conditions of this agreement.

 

i) Billed Discreetly . You understand and agree that Your Purchase or participation to The City Discount Card will be billed discreetly to your credit card, debit card, or checking account as City Discount Card, a division of Suncoast Identification Solutions, LLC.

 

j) Changes to Your information. By Your Participation in the Program You agree to and understand that the company, business or other entities personal information supplied by You or Your Company or Other Entity may be updated at anytime without charge subject to reasonable limitations and availability of the System.

 

k) Changes to Your Ad or Listing. You may change your advertisement once monthly free of charge for each ad on our directory. We are a human edited directory therefore we charge for changes after that. You further agree to, understand and acknowledge that you are aware of the fees, applicable for ANY and ALL changes initiated by You, will be charged against your account and automatically billed to the credit card we have on file, or a checking account, or other payment type, including but not limited to a emailed, faxed or mailed invoice, to the billing address associated with Your account. Such fees are subject to change with or without notice. Our fees are $15.00 per change per ad or listing without limitation unless otherwise stated in writing and said written statement must also contain the signature of an owner or officer of the Company or an authorized representative of the Company that was appointed directly by the Company.

 

l) Payment for changes. You agree to, understand and acknowledge that You are responsible for prompt payment of ANY and ALL charges incurred by You as a result of your initiated change or participation in or on The Program. ANY and ALL outstanding balances are or may be subject to additional fees if balances are left remaining for more than 5 business days and or if the Company has not received your payment by mail or your credit card was declined or not authorized for any reason. Any and all additional fees are at the sole discretion of the Company.

 

m) Billing Records. Upon request, Subscribers will be given access to billing records that support charges for use of The City Discount Card.
